Your privacy is important to us. This policy explains how we collect, use, and protect your information when you use pirch.ai.

Pirch holds the privacy and safety of our users in highest regard. We would like to familiarize you with the types of personal data we collect and process, why we need it, who it may be disclosed or released to and under what circumstances, and your rights regarding your personal information. This policy applies to all of the Pirch Services. Please take a few minutes to carefully review the policy. By using our sites and services, you acknowledge that you accept and agree to this Privacy Policy ("Policy"). The Policy incorporates all definitions and terms contained within the Terms and Conditions that govern the use of the Pirch Services. By continuing to use the website and the Pirch Services you expressly agree and accept the conditions of the Policy. We have included privacy contact options below if you have any questions or concerns about our privacy policy or practices. We also encourage you contact us if you have any visual or language accommodations that we can assist you with. We may update our privacy policy from time to time to in response to legislation changes or technical protection improvements and therefore you must periodically check this policy for updates. Most of these updates will not change the types of personal data we process, the purpose or our legal obligations for disclosure or retention requirements that would be considered a material change. If we do make a material change to our Policy, we will post a notice thirty days prior to any changes to our existing data collection and processing practices. The effective date of our most recent update is identified at the top of this Policy.
1. Definitions
"Personal Data" means any information that identifies, relates to, describes or is reasonably capable of being associated with or linked, directly or indirectly with an individual.
Personal Data includes, but is not limited to: your name, phone number, email address, your physical or postal address, student ID numbers, accounts and passwords, social security number, date of birth, place of birth, your device IP address, biometric information such as your photograph or fingerprint, education records and any data associated with health or family financial information.
We also use the terms aggregated data and de-identified data when we discuss educational reporting requirements, statistics, and research.
"Aggregated information" means that data that could directly or indirectly identify an individual has been removed (de-identified) and the remaining data has been combined with multiple records to use for statistical information and summaries.
2. Types of Information Collected
We collect two basic types of information – personal information and anonymous information – and we may use personal and anonymous information to create Aggregate Information as defined above. In particular, we collect:
- Registration information you provide when you create an account or link your profile on a third-party site or platform, such as Google, with your registration account, which may include but is not limited to, your first name and surname, child's name, country of residence, gender, date of birth, email address, username, and password;
- Information inputted by you into prompts and outputs generated from those prompts;
- Transaction information you provide such as your postal address, telephone number, and payment information;
- Information you provide in public forums on our sites and applications, such as your public posts;
- Information sent either one-to-one or within a limited group using our message, chat, post, or similar functionality, where we are permitted by applicable law to collect this information;
- Information we obtain from a third party, such as a site or platform provider, about use of our applications on third-party platforms or devices;
- Location information, including precise or approximate location information provided by a mobile or other device interacting with the Pirch Services, applications, or physical properties (including through beacon technologies), or associated with your IP address or other online or device identifier, where we are permitted by law to process this information;
- Activity information about your use, and the use by any person(s) you authorize through your Pirch Services account, such as the content you view or post, how often you use our services, and your preferences;
- Usage, viewing, technical, and device data when you visit or utilize one of the Pirch Services, use our applications on third-party sites or platforms, or open emails we send, and other similar technologies, including your browser or device type, unique device identifier, and IP address;
- We do not intentionally collect information from any children, as outlined in the Terms, the use of Pirch Services is reserved for adults over the age of 18.
Pirch is designed for use by parents and guardians, not children directly. However, we recognize that children's personal information may be entered by parents during educational planning or profile setup. In such cases, Pirch complies with the Children's Online Privacy Protection Act (COPPA) and does not knowingly collect personal information directly from children under 13 without verifiable parental consent.
Parents or legal guardians maintain full control of the accounts and may review, modify, or delete their child's information at any time by contacting us at suport@pirch.ai.
In educational contexts, Pirch also follows best practices aligned with the Family Educational Rights and Privacy Act (FERPA), ensuring that any educational data provided by users is used solely to deliver personalized learning services and is never sold or disclosed to third parties for marketing or profiling purposes.
We may also collect information from third parties, such as a site or platform provider, about use of our applications on third-party platforms or devices.
3. Ways Information is Collected
- We collect information you provide directly to us when you subscribe to or purchase Pirch Services or participate in public forums or other activities within Pirch Services. You may provide information in a variety of ways, including by typing or using voice commands.
- We collect information through a variety of technologies, such as cookies – including but not limited to technical cookies, analytical cookies, functional cookies, flash cookies, pixels, tags, software development kits, application program interfaces, and Web beacons, including when you visit our website and use Pirch Services or use our applications on third-party sites or platforms using one or more devices, whether or not you are logged in or registered.
- We collect information using analytics tools, including when you visit our sites and applications or use the Pirch Services on third-party sites or platforms.
- We collect general usage data about the number of visitors that visit our website and internal environment to see infrastructure and application performance trends, load times, errors and slow transactions. We use this data to ensure our infrastructure and applications are sized effectively for performance during peak usage times and the overall traffic volume, monitoring and troubleshooting of any issues and improve the Pirch Services. This data may include the connecting device vendor, device types and versions such as IOS 13.6.1 or Android 10, session identifiers, device IP addresses, browser types and version information.
- We acquire information from other trusted sources to update or supplement the information you provided or we collected automatically, such as when we validate postal address information using third party services. Applicable law may require that you authorize the third party to share your information with us before we can acquire it.
4. How We Use the Information
- Provide you with the Pirch Service you request, view, engage with, or purchase;
- We may store or review prompt inputs and generated outputs to improve our services or assist with customer support. Users should not enter sensitive personal data into prompt fields;
- Communicate with you about your account or transactions with us and send you information or request feedback about features on our Pirch Services, website and application or changes to our policies;
- Send you offers and promotions regarding the Pirch Services or third-party products and services that may be recommended by Pirch;
- Personalize content and experiences;
- Operate, understand, optimize, develop, or improve our websites, applications, products, services and operations, including by using guest survey research and analytics tools;
- Detect, investigate and prevent activities that may violate our policies, pose safety issues, or be fraudulent or illegal;
- Notify you of any issues discovered.
5. Sharing Information
We will not sell, rent, or otherwise provide your personally identifiable information to any third parties for any marketing purposes. We will only share your personally identifiable information with third parties to carry out instructions and to provide specific services. For instance, we use a payment and credit card processing company to bill users for subscription fees. We may also use third party software development firms and server hosting services. There may be limited circumstances in which we share the personal information including:
- When you allow us to share your personal information with another company, by expressly selecting to share your personal information;
- When you direct us to share your personal information with another company to fulfill your request;
- When you direct us to share your personal information with third-party sites or platforms, such as social networking sites;
- When we work with service providers performing services on our behalf; however, these companies are prohibited from using your personal information for purposes other than those requested by us or required by law;
- If we provide you with relevant advertising on third-party sites and applications, we may share limited personal information about you, such as certain identifiers or hashed email address, with third parties. We may also share such information to provide you with and to measure relevant third-party advertising on our sites and applications.
- When we share your personal information with third parties in connection with the sale of a business, to enforce our Terms or rules, to ensure the safety and security of users and third parties, to protect our rights and property and the rights and property of our users and third parties, to comply with legal process, or in other cases if we believe in good faith that disclosure is required by law.
Please be aware that if you do not allow us to collect personal information from you, we may not be able to deliver certain Pirch Services to you, and some of the services may not be able to take account of your interests and preferences. If collection of personal information is mandatory, we will make that clear at the point of collection so that you can make an informed decision whether to participate.
6. Data Security and Protection
The security, integrity, and confidentiality of your information are extremely important to us. We have implemented technical, administrative, and physical security measures that are designed to protect our user's information from unauthorized access, disclosure, use, and modification. We regularly review our security procedures to consider appropriate new technology and methods. Please be aware that, despite our best efforts, no security measures are perfect or impenetrable. We will retain your personal information for the length of time needed to fulfill the purposes outlined in this privacy policy unless a longer retention period is required or permitted by law.
7. California Residents
Under California Civil Code sections 1798.83-1798.84, California residents are entitled to ask for a notice describing what categories of personal customer information we share with third parties or corporate affiliates for those third parties or corporate affiliates' direct marketing purposes. That notice will identify the categories of information shared and will include a list of the third parties and affiliates with which it was shared, along with their names and addresses. If you are a California resident and would like a copy of this notice, please submit a written request to suport@pirch.ai and please allow 7-10 business days for a response.
